Selling a photo


I took a photo of a band the other week as they were doing a soundcheck in the theater they were playing at that night. What are the rules on selling the photo?

  Andy, it would depend on the buyer -- are you trying to sell it to the band in the photo? Good luck with that.... :)

Rules are that you can get into a heap of trouble without permission from the band and a signed model release. If you were taking pictures on your own without permission, chances are you can't sell it for commercial use. You may, however, be able to license it for editorial use, which does not require a signed release. Most stock agencies will not take it without one, though.

Without more info on your role at the venue in question, it is difficult to determine what your rights are regarding the images. If it were me, I would get permission from the band via their publicist or general manager before trying to make a buck.
