Liability when posting kids pics to share site?


I took personal photos at my own kid's field trip. A few of the mom's thought it would be nice to have website not affiliated with the teacher or school where we could all upload our photos and share. Shutterfly.com has a great share site that I can invite who I want to access the photo albums that is password protected and no general viewing.

Can I upload photos that have other kids in the pictures without their parents permission? Or do I need their permission? I am not a professional photographer and have no intent of making a profit. It is strictly for the mom's to enjoy sharing their little ones.
Also, if the kids have on their school shirt on and the name of the school is on it visibly, Will I get in trouble with the public school? Once again no profit motive---strictly a share site.

In the US teens or single parent welfare moms that download 100 MP3s illegally get sued for US$ 800,000.
So, like they say: in the US anything is possible...

Better toe the line on the safe side, Heather. Or emigrate to a country where citizen's rights are protected a lot better...!

  send out an email first asking permission. Then post them to a password protected place (like you're suggesting).

I photographed a lot of my daughter's Kindergarten parties. At the end of the year, her teacher passed around a sign up sheet at a Mother's Day event and asked the mothers to sign up if they wanted the pics on the cd. If they did not want pics of their kids on the cds, they were to let her know. She told them they were not allowed to post the pics online. I thought it was all handled really well.
