Awarding Uncredited Art Duplication


I'd like to understand the rational for awarding a finalist (or possibly higher) award to an uncredited duplication of artwork by someone other than the photographer who entered the submission.

This is wrong. And probably a violation of the artist's copyright to boot, unless the artist has granted permission for this (which I highly doubt.)

  David, I can see your point but I don't think it's right to post someone's photo without their permission. You could have mentioned the name of it without posting the actual photo.

  Perhaps, but, she AT LEAST should have credited the painter. Which, might I ask, is worse? And, I'm sorry, but I want people to SEE what I am talking about.

I'm surprised. I recieved an email from a friend of her's telling me how sweet she is and suffering through a family medical issue and I shouldn't ruin her wonderful time. And you are questioning my posting a link to a questionable contest winner.

What about the fact that BP has awarded a finalist medal to a reproduction of someone elses work? Without crediting them? And, I suspect, without thier permission?

How would you feel if someone downloaded one of your images, made some minor adjustments and then entered it into some contest and WON?

  She did mention was painting in her description...so it an honest mistake, in my opinion. I think it far worse to publically drag her name thru the mud. A simple, private e-mail to her voicing your concern, along with an e-mail to BP, probably would have been fine, and the honest mistake could have been corrected. And...BP did award the finalist, knowing that it was a photo of a painting.

  I can understand, but you also have to ask the same question of other works of art. You have a lovely statue in your gallery, with no credit to the sculptor. At what point do we draw the line? The painting at least shows the artist's name. Do I think it belongs in a contest? No..., If I'm being honest (sorry Lynne, you know I love you), it's almost as though they are judging the artwork rather than the photo... But the same can be said of statues and other works of art.

You're right, where does one draw the line. I would have credited the artist if there was any credit near the statue. I tried to find out who the artist was... I wasn't able to.

And I debated whether I should post that statue image or not. I finally decided to, since such images of statues in surroundings or very close up details seem to be widely accepted as OK. Indeed, I would have no problem with Lynne's image if it included SOMETHING of the surroundings.

But, this was a one-to-one direct reproduction of an entire (or almost entire, maybe she cropped slightly) single work of art and nothing else.

Copyright law is very clear on such reproductions... it is, plain and simple, a violation (unless she got permission from the artist.)

But, where exactly does that line lie? Quite frankly, I'm not sure. Perhaps I crossed it too. If so, I'll be happy to remove my image. But, the law gets quite fuzzy once you move away from a 1:1 repro.

However, my complaint is more with why BP awarded such a submission. Had it not been awarded, I would not be posting this.

  As per private email... perhaps I should have approach this issue in that manner. Maybe you're right.

But, to me at least, this is such a major oversight or ??? by BP that I felt it really needed to be illuminated.

BP's judges are supposed to be PROs. That they could allow such major errors to occur (or, at least, I sure hope it was an error!!) indicates a serious problem.

BP has a habit of not responding to such problems. Take the issue of the same photo winning two months consecutively in the same category. I have yet to see any rule change or even any acknowledgement of that issue.

If BP hopes to continue to have any credability and respect for thier contest, they must address these kinds of problems.

I like BP. I like this contest. But when I see things like this, my respect deminishes.

  the disappearing thread shall reappear.

One point about the statue vs painting. Artist who are being covered by newspapers don't want their paintings photographed straight on. Only at an angle. So there is something to it being different.

  I do understand your concerns... A while back, someone posted a photo of a scene on their television that ended up as a finalist. Several people were uncomfortable with that. I'm not sure how a photo can win twice in the same category, I know of similar photos that have won twice... (One of a set of greyhounds racing comes to mind)... Same photo winning is unfair. I also disliked the way the cash contest was run. Winners of the free contest were barely changing their entries and entering them in the cash contest. I for one don't have a problem with you bringing up the question. I do think you were a little insensitive in the execution though. You could have asked the question and written a good example as I did above, or at least emailed BP seperately first to ask your question. Bringing someone's name and work (I mean the photo not the painting) in without first giving the person the courtesy of a "Hey, I don't think this was right" in private was a little much. I had similar questions recently on another site, and I stated my concerns to the people in charge rather than embarassing the person in question in a public forum. I think you had good intentions in bringing an issue to the front, but perhaps in the future, you could temper your quest for rightness with a little compassion for someone who may not have understood or meant to do wrong.

Interesting--I didn't know that!

A couple weeks ago I was at a farmer's market and there was a quilt show. I took photos of lots of the quilts, but later realized it probably would be some kind of copyright violation to use them without permission. It made me think about a lot of photos I've taken, or others have taken, where the "fine line" is more or less hard to discern.

I looked through some of BP's past contest winners to see if any winners/finalists were of another's artwork. I didn't see any, but that doesn't mean that some haven't gone through.

Today I was taking photos at the county fair--of the rides, etc., not people. And I started wondering if the artwork on the rides (carousel horses?!) was copyrighted! :P
