Property Releases


I am looking at doing a series of photographs for a gallery. My question would be this: If your doing work for a gallery and you do a shot of a recognizable property, do you need to get a property release? I would really appreciate any input on this that I can get.

  According some I've read opinions from (here and elsewhere) ... none of whom are legal experts ... YES.

According to Dan Heller (a published book author on such topics) the answer is NO.

Keep in mind, however, that Heller also is not a legal expert, although I would expect (hope!?) that he and/or his publisher had legal experts review his books prior to publication.

You can find articles on his site on limitations / gotcha's to avoid when publishing such images for 'editorial' reasons (and his definition of editorial, which, if I read correctly, includes gallery displays.)

However, you could try to get a release from the property owners to be on the safe side. However, that could open a can of worms, so......

  Oh, let me add the following necessary disclaimer to the 2nd sentence... IF I CORRECTLY UNDERSTAND WHAT DAN HELLER STATES .... the answer is NO.
