Using photos in a studio


someone asked me and I do not know the correct answer.... If you got to a studio and get you childrens photos taken can they use that photo in there studio for advertisment (ex. on the wall of the studio) without permission?

  More than likely the agreement they signed had a statement regarding this and they granted the photog permission by signing.

  Absolutely not, unless, as Todd correctly notes, they signed something that resembles a parental model release. BUT even if they did, and the studio is using the photo with consent, calmly tell the studio manager to take it down. I'm sure they'll oblige.

And if the next question is "can we sue the studio" if they posted the pix without permission, the answer is "of course". These days, sadly, it seems that anyone can sue anyone for anything. But in terms of recovery, that wouldn't be likely as this scenario seems to fall squarely under the "no harm no foul" doctrine. In Latin, that's "De minimis non-curat lex". (The law shall not concern itself with trifles) If you're a vegan, I guess that would be "truffles". I don't know the translation in Vulcan.
