License We live in the state of Indiana. My son, who is graduating this year has decided to go into photography. He has already taken some friend senior portraits and has others who want him to do thiers. He decided to make a flyer and advertise that he does this. Someone said that other photographers in the area may file a complaint because he is not licensed. Does he have to be licensed? To me it is like putting up a flyer to do yard work. I understand that eventually we will get a BUSINESS license if he decides to really open a 'shop'. But right now he is just in high school.

Local photographers cannot go against others. You do NOT have to be licensed, you are just taking pictures. Everybody is free to put up fliers. You will, however, need release forms from the subjects if your son will be selling or distributing these pictures to people other than the subjects.

Well Dawn, the short answer is unless Indiana has changed it's laws recently, no professional photography license is required. There has been talk in New Jersey and NY of licensing photographers who shoot weddings and events, however. I'm actually quite in favor of that particular licensure requirement, but it hasn't passed at this point. As far as "other photographers going against other photographers", it happens all the time for one reason or another, usually interfering with a pre-existing contractual relationship. Before taking the plunge to go into photography, you didn't mention graduating from what. If it's high school, I'd certainly try to encourage him to go to college, get a broad liberal arts education with further studies in art and photography, (take a look at Columbia, Depaul, or even the Art Institute 4 year programs in Chicago).

By the way Dawn, here's a response to kinda sort of a similar question yesterday that either you or your son might be interested in reading. http://www.betterphoto.com/forms/QnAdetail.php?threadID=28575 Mark

Ah I'm all to familiar with the IRS and that is why I said eventually we would get a business license. We own a video rental store.....so I know all about the self employment deal....but right now he is just a kid.....graduating HIGH SCHOOL. Thanks for all the help. And Mark.....he has checked in to Savannah School of Art and Design. Any thoughts or knowledge on that school?

throwing people off?not sure about that.so these photographers, with a license, won't mind a high school kid taking away from their work, income.without a license. so if,and some are vindictive, they file a complaint with the bbb,and they say they don't have a listing, what happens? he's a high school student and we'll overlook it.. that would be nice. I know I want to live in mayberry, but it's gone. but without the post I would'nt question myself. thanks, sam.
