Sports Logos in Studio Photography


My fiancee owns a dog training & behavior company. I have offered pet/family studio photography out of his business for about 6 months. I have someone who wants to bring her dog in and have his pictures taken in the studio with an Ohio State Buckeyes football jersey on. I'm nervous about selling images of licensed logos. Does anyone know what the laws are? Am I allowed to do this?

  Nope. Sure can't without written permission from the people who hold the copyright and/or trademark protections on the Buckeyes logo. Well, you could but what's your actual net worth?

  I am not a copyright attorney, but it is my understanding that...
If it is simply a portrait that the family wants, there is no problem. Assuming the jersey isn't an unlicensed knock off, the family has already paid the copyright holder and have a right to photos of it for personal use. You, the photographer, will only run into copyright trouble if you offer the image for general sale as a stock photo, posters, greeting cards, etc.

  The impression I got from Mari's question was that this is to "sell images of licensed logos", rather than an individual doggie portrait and a couple of prints to someone. If I assumed to much, then Jon is right. Portraits of people wearing trademarked logos, for personal use rather than commercial sales, is just fine.
