Terms of Usage Agreement


I would like to enter some pictures to a local tv station for a contest but their Terms of Usage Agreement sounds a little strong, here is the agreement and does it sound normal for a contest?

License. You grant KASA FOX 2 a world-wide, royalty free, perpetual, irrevocable and non-exclusive license to use, reproduce, modify, adapt, publish, distribute and/or display the picture anywhere, for any purpose, and in any form, media or technology now known or later developed. No compensation will be paid with respect to the use of your picture. KASA FOX 2 is under no obligation to use or post any pictures you provide and may remove any posting at any time.

  Unfortunately Brian, a lot of people don't read the submission rules/guidelines for contests and this is the trap they fall into. If you enter this countest, even if you don't win, you forfeit your first world wide-(including north american) publication rights to your own work without receiving a penny for them. Fox can take your images and put them on a CD and give them away for stock.

AOL tried this stunt several years ago. The language was cooked up by some seemingly clever guy at AOL and buried in their submission guidelines. It wasn't even for a contest but just to upload a photo to your own online gallery !!!

I wouldn't do this if I were you, and let others know your views there too. Write em a note and tell them no way.

  Buy submitting your picture, you basically give it to KASA FOX 2. What do you get if you win? Recognition? I wouldn't do it.
