Photography Question

Kerby Pfrangle

Request for image usage

I have a letter from a lady who wants to use one of the pictures of my eleven year old model in a college report.

SHe would not be profiting from the image and my first thoughts are just to let her use it and ask her to give me image credit.

I am just asking for opinions and what other people would do.

Is there any questions I should be asking before I email the image?

Kerby

Hey Kerby... can you establish that this person is legitimate in any way? Seeing as it's a child's image, I'd be a little more cautious personally... What college? What is the report about? How/why will the image be used?

I'm not generally cynical, but I'm learning to be so a little more as I get older :)

  Hi Denyse

I wrote her back and included your questions.

Thank you for your response. It hard to know what to do sometimes.

Kerby

Hey Kerby: My answer is absolutely not unless (1) You have a release signed by the kid's parents allowing you to use the image. (Including your signature if it's your kid). )2) You agree in writing on a one-time usage fee, and that she understands and signs an agreement stating that she will not duplicate or transfer her usage rights to any entity in any manner or form absent your written consent and an additional usage fee. (3) That prevents anyone from publishing her so-called "report" and (4) That her right to publish the photo consists specifically of only that photo in a single report (one report only) [not a thesis to be disseminated in dozens of copies and perhaps sent to an academic publisher.

In other words Kerby, YOU control the usage of your own images and the use of your copyright. Can you dig it?

Welcome to the majors.
Mark

Kerby, I received a similar request from a gentleman. When I requested more information from him, he never replied. The information I requested was: what college, his status, a student, TA, or prof, etc., and what the report is about.
I have a feeling that there are others who may have received the same type of message (just my gut feeling). I hope others would come forward and tell their account.

Like Denyse, I am generally very trusting, but I'd be very cautious with some of the requests that I receive through the contact button on BP.
After establilshing communication with the requester and feeling confortable about her request, I would still follow the strict guidelines Mark outlined regarding the model release and the usage agreement.

  Thank you very much Mark.

I know I have the right to my images to use as I see fit with Keshia's parents but I have to talk to her parents about releasing the image for a report.

I glad I have not sent anything yet.

I am beginning photographer so I could not ask as much as a professional but what would you ask for one time useage fee and how would you know if that what they did with the image for sure?

Nobi this was a lady who requested the image.

Has anyone else on the site had similar requests?

Kerby

hey Kerby, I would like to know if you would hear from the lady and found that she was truly legitimate. I wish my guy was...

I knew your contact was a female person. So, I specifically stated in my case the requester was a 'gentleman' (although I actually don't know whether he/she was. I just assume from the name).
