Photography Question

Property Release


I am working on a photo book. I know I need model release for the models and property release for the land we are shotting on. My guestion is I need a photo of the Ohio River do I need a property release and if so from whom. The state of Indiana or Kentucky.Please let me know. Thanks

  Nope. BUT, when shooting on public property for commercial purposes, technically you may require a shooting permit as is the case in CAlifornia, Illinois, New Jersey and New York. On the other hand, if you go about shooting unobtrusively, as in leave the mobile home, commercial generators, model prep. trailers, etc., at home, you'll probably be ok.

As to the private land you're shooting, unless your images depict particular fixtures, buildings, (houses, barns, out buildings, etc) or patterns unique to the property that would make it identifiable over other properties or land use, then no, you don't need a release for that either. On the other hand, by obtaining releases by say approaching someone working on the property or by knocking on someone's door, back there, you're likely to meet some nice and interesting folks who might let you photograph them as well as part of your project. AND, they might not only let you on the property to shoot, but might even help you find a better angle or view than you'd get without enlisting their help.
