Model release question


 
 
I like to use these two Pepsi Photo balls on postage stamps and also in the contest. I was wondering if anyone knew how to get a release from Pepsi or if you thought it be possible to do this. Who would I contact to do this.

  Whoa, Kerby that could be tough! I'd search on-line for their headquarters and start there.

The company I work for makes custom car parts & does custom engraving... the big car companies like Chevy do not give out any kind of releases on their symbols. I'm sure every company is different, but I think you'll be hard pressed to get a release from a large corporation.

  Hey Kerby ! The Pepsi logo in your images is trademarked and protected. I think it tells you that on the can. But, you knew that. For a release, they're based in New York City. You should contact their director of media relations there.

Thank you for responding to my thread.

I contacted the head advertising guy at our local Pepsi plant and he is going to send the designs in to see if I can use them on postage stamps and in the contest.

He really loved one of them big time.

But I just want to put them on postage stamps.

  Hi Kerby!

I entered a pick of a coke can in december which is now a finalist, so does this mean I should have got a model realease from them then? I have emailed them the link to the photo and am awaiting their response.
I am worried now :o(
please let me know how it goes with the Pepsi company! Great pics by the way!

  Rachel that is interesting. I check your Dec finalist out. I really hope you win. I have my fingers crossed for you.

The Pepsi company here is doing the work for me to see if I can use the Pepsi Photo Ball on Stamps on my Zazzle account. You can order Stamps, note cards, posters and T shirts with any image you want but I am sure you have to have a model release when your using someones logo for postage Stamps.

  The contest rules state that you have to have a release before entering the contest. It is stated before you click the "I Accept" button. Without a proper release, photos/images should not be entered into the contest. You should not have to get one, as you already have one (according to the rules).

  Justin I do not know if they let me use the logo or not for the postage stamps or in the contest.

The local Pepsi advertising man really liked one of the Pepsi Photo balls.

I am really hoping they say yes. I love to do a whole line of photo ball products. It would be really fun.

photography is just a hobbie for me and perhaps I am a little nieve, but I really throught that a model release was only for pictures of people, and would not have entered it if I had realised that I needed a model realease. If the coke company are not happy then I will remove the photo. I will let you all know what they say..

  Rachel, for the record, it's a property release, not a model release. Yes, models are for people. Property covers everything else from Pepsi and Coke Cans (and their trademark protected) to private buildings, etc.

And...Kerby, a corporation is VERY protective of its image, trademarks, copyrights, patents and protected logos. It's their property afterall. So, they decide who can use it for what, when, where and how, if at all.

Oh, and Justin is absolutely right. You shouldn't enter an image in a contest based on the possibility of getting a future release. You should have it BEFORE it's entered.

My bet is Pepsi will not let me use my pepsi photo balls but I think I have a stronger case having the local Pepsi company check into it than just me doing it.
Plus the local Pepsi advertising man liked one of them.

SOmewhere in the back of my mind I do not think they let me use them.

But you never know until you ask.

  I got an answer from the Pepsi company and the answer was absolutely not. I can not run the images in the contest or make my postage stamps. We heard back from the legal department at Pepsi. They are extremely protective of their logo's.

I took off all my Pepsi photoball on the site so you do not see any images any more on this thread or on my Better photo page.

I told a couple people I write back on the message boards what happened so this is the rest the story.

No Postage Stamps or Contest entries with my Pepsi Photo Balls.

I personally think that you should use the images since pepsi uses a coke can in a jackie chan stunt double commercial. As long as your not making money on the images.

  That's a great idea Kerby. That way, when Pepsi sues you for infringement of their trademark since you didn't make any money on the image, you won't have much for Pepsico to attach, right?
You can just use the easy payment plan to satisfy any judgments against you.
