Need help ...magazine wants pix I took


Hi...

My daughter dances with a local professional dance company. I photographed pictures of a fancy Gala that was held as a fundraiser. A lady from a magazine got my email address as she was interested in my photos to use in her magazine to go along with the article. This is all NEW to me. She just sent me an email inquiring about the photos. How do I go about having her view my photos? Do I just send her a CD of all of the pictures...and ask her after she receives it to send me $ for the CD? How much should I charge? Do I need to get permission from the dance company to sell the pix? (I don't think they would care since they would be getting free advertisement...I really don't). PLEASE HELP...as I need to reply to her email!!!! I have NO clue how much to ask...or how to proceed. HELP!!!!!!!!!!!!!!!!!!!!

  Well I"m not a legal expert on this . . but I'm thinking you would need model releases(or the magazine would) for the pictures. . . Especially if they are under age. . . as far as allowing her use of the imgaes. . . I would get everything in writing . .. and when giving her the CD I would give them to her in LOW RES with some kind of watermark and then have her ask you for the ones she wants to definitely use. . . at that point negotiate a price and find out in depth and specifically HOW she will use them. . .YOu need to decide if you are giving a one time use, exclusive use, etc. And then I'd get some $$$$ beforehand or they may drag their feet in paying you . .. as far as how much to charge. . . well that I can't help you with!

  O.K. You need a model release. Only send the VERY EXCELLENT PICTURES. You need to be your own worst nightmare editing what you send her. Let her know you would be happy to SEND her the prints/images. She's probably busy so don't ask for an appointment unless SHE sets one up. Starting out it's tough to figure a rate because you don't know what they charge, what their circulation is, etc., so tell her that you will accept ner standard rate for submitting images because they have done this before and if you're doing this for publicity or self satisfaction then the money is sauce for the goose and your not knowledgable enough about her business to be pushy. Yeah, there are some rip off artists out there, but quite honestly they are few and far between. Don't insist on an advance. Their magazine. They're the boss. Let them be and relish in the fact that you will be a published photographer.

  P. S. Worried about copyright infringement? Make dupes of your images and mail them to yourself. They are sealed in a package post stamped by the US government with a date on it. Leave it sealed and clearly ID it and you've got you BACK OFF, IT'S MINE! proof.

  Thanks you guys! Now I need specifics...
1. Do I email the magazine and ask them to send me a model release or is there one I can find on-line somewhere?
2. How do I transfer my pix to a cd in low resolution? Do I do that through my photo editing software? I can also put a watermark on it in my photo editing software.
3. So, after I have received the model releases (from whereever)...and I transfer the images to a CD in low resolution...with a watermark...I will then mail to her and await her response as to whether she wants any of the shots?
4. Say she likes the photos...then she will mail me a check...and I in turn will transfer the high resolution images onto a CD and mail her? Done deal?

Hmmmm.....there are a number of reasons people submit photos for publication. In this case Linda might be looking for a publishing credit. That alone could be worth not setting your price too high. Being a photographer is one thing, being a 'published' one is another and makes editors pay attention (it does with writing anyway).

I once sold a magazine piece (no one gets rich doing this)--2500 words for $200 and then $25 each for 4 photos I submitted. That'll give you SOME idea what the pay is. Have a scan through Writer's Market to get an idea what accompanying photos are worth.

The other reason --because not everyone does stuff for money--is the publicity her daughter's company will get if it's a local thing. Lots of us do stuff for no money if the pay is in some other form we think has value.

It does sound though like there should be some renumeration. Check the writer's/photographer's guidelines online for the mag and you'll see what they're paying. I doubt the magazine will use your photos without your permission. It's too risky a business for anyone reputable.

The mail copyright is a good idea and will cost you a stamp.
