signed release for gallery?


Hi,
I noticed that a some members have portraits in their galleries.
Do you get the client's to sign a release for this? Some of my clients have signed releases for publicity purposes and I'm wondering if that would apply to this site?

  Yes Lili we ALL have releases for every single model and property we shoot! (wink wink).

As we should and are legally obligated to we probably don't. This site is extremely friendly so no one stresses on releases (because this site is about learning). Other sites we should be careful and especially newspapers and mags you need them.

  You do not need releases for entering into a photography contest generally. Only where there is money and high exposure envolved.

  The Rules State That You Need Model Releases!
Model Release
Uploader acknowledges that they have sufficient written permission of any recognizable models or other persons appearing in the photograph to be able to grant to BetterPhoto.com the right to publish their photographic submission online, and hereby grant to BetterPhoto.com such right.

  To save time and hassle in getting releases after the fact, I include the following statement in my contract:

"Photographer retains ownership of any photos taken, and reserves the right to use these images, as photographed or altered, for contests and promotional purposes without further obligation to the client. "

This way I have it, and I don't have to worry about anyone coming after me later if I "forget" or just can't get a hold of the client.

  I have my models/clients sign a release at the beginning of each session. When I collect their session fee, I have them sign it as part of my "client session package." Also included is a legal liability waiver for any illness or injury before, during and after their session in my home/studio, a price sheet, an order form to take home, brochures or special offer flyers and a statement regarding how and when proofs will be ready to view on my web site. This way, I have all my bases covered at the beginning of a session and don't need to go back to them later for anything.
