Selling Photos


A person takes photos for a newspaper and they pay the person by the hour at the event(s). Newspaper doesn't pay for photos.
A few photos will be published in the paper. The newspaper then puts them on their website for sale.
Who should get the money from the website, the photographer or the newspaper company?

  From what I understand, this would fall under working for the paper, so the newspaper would own the rights to the images. Unless some other agreement had been made in writing before had (or can be agreed to post fact). You could ask that they give you the credit for the photo, if not monetary amounts, for atleast portfolio purposes.

Are you freelancing or a staff photographer. If you are staff, they own the pics, if you are freelance you own the pics, unless you wigned a "work for hire" agreement, which would give them ownership. If they are your pictures, the newspaper should not be selling your copyrighted pcitures. If they are, you should get a cut. That si the way alot of the news agencies work.

  Thanx, Robert & Charlie. Your input is very helpful. At this point I'm considered staff. I've negotiated so I get paid more for the photos.
