Selling photos of other artisits


This question might have been brought up before but I need to know.
1st. I took pics of a local festival where chalk artists draw images from well known artists. It's a public forum and many photos are taken.
2nd. I changed the images by cropping adding effects ect.
3rd. I sell at a city run arts and crafts show. I have used the changed images to sell.
4th. I was told by the "monitors" at the show, that I can't sell "other artist work" Even tho the artists copied someone eles work. No copy-rights are inforced because it's a non-profit festival.
5th. Is it legal for me to sell these images after I make them my own by changing them?

I dont think you can sell such images. Even if you have done your changes, you can not sell them. Because the main subject of you photo is that paitings, which is a copy of some other artist.

It is same as, if you go in museaum and took photos of thoes paitings and then, modified little and tried to sell them. In this case also u will be violating a copyright of that original artist.

If you have taken a photo of a chalkt artist drawing the picture, and the picture is not fully visible, and take a model release from him. Then you might be able sell it. In that case the main subject should be the artist drawing something and not the picture he has drawn.
