Selling a batch of digital photos I recently covered a large, invitation only, grappling (martial arts) event. As I'm getting my pictures online I'm having people contact me about buying them. One of the fighters (a World class athlete/2004 Olympian) asked if he could purchase all 46 photos of himself, to be sent digitally on a CD, but without my watermark on them. I can understand him wanting that off, but I still want recognition for the photos. Is it ok to tell him that I'll put a smaller copyright on the lower right hand corner, and that if he uses the pictures for anything (which I know he will) and he decides to crop off the copyright that he needs to give me credit where he uses it? Also - what is a reasonable price to charge him for that number of pictures? Thanks in advance for any help any of you can give me! Alicia Anthony

Hi Alicia, I'm assuming that you don't have a model release from any of the Athletes. If that's the case, I'd set a modest price for them, and take what you can get because they probably won't have much marketability to you anywhere else without the a release. If you think that the images could have a strong market value in the future, or want to use them to showcase your work, you may want to let the images go to him at lower price, if he will sign a model release. The copyright is yours whether you put the symbol or not, but I wouldn't try to sell these images anywhere else without a model release. Hope this helps!

Oh, since this event was by invitation, I'd also double check and make sure that there aren't any conditions in regard to copyright ownership on photographs taken at the the event that you may have inadvertently given away by accepting the invitation.

Thank you for the replies! Is there someplace I can see a sample of a model release? I know this athlete in particular would use the photos to market himself. He markets his services (training/health/motivation/etc) quite frequently. I have no problem with him using the photos, but I'm also trying to get my photography business off and running, so I'd like his assistance in promoting me if he's using my pics. As for copyright ownership on the pictures, none of the photographers signed anything saying there were conditions as for how we can use our pictures. I've seen plenty of other pics from the event all over the net already, so I'm assuming we can all do as we please with them (?) Thanks again, -Alicia

If you do a google search on "Sample Model Release" (without the quotes), it'll turn up a LOT of samples for you pick from. Here's the first one the came up when I did it: http://www.accesskansas.org/facts-history/photo-modelrelease-form.pdf There may be others that suit your needs better, but I'll leave that to you. You may want to allow him open license to use them to market himself, on condition you are credited as the photographer in any publications, and/or in exchange for the model release, etc... you know the situation better than I, so I'll leave it to you to decide what arrangement will be the most mutually beneficial. If the invitation, event pass, or any of the event literature didn't have any provisions, conditions, or statements of regarding copyright, then you are probably okay as long as you can get the model release.
