Business Name & Copywrite question


I've been racking my brain for the last month trying to decide on a name for my photography business.
There has been several that I've toyed with but than as I was falling asleep last night a name came to me and right away I punched it in on the search engine to see if it's already being used.
To my disspointment there it was, just ONE other business in the search engine with my same idea.
My question is, if I change something small like ending the name with Photograpic art instead of photography or if I spelled it differently, would it still be copywrite infringment?

Example: His says Beautiful Photography
Mine say's Beautiful Photographic Art
or Beautiful Digital Photgraphy.

If someone knows more about this please let me know.
I fell in love with the idea of this name and I'd hate to keep on searching.

  Did you just "Google" the name,..or did you search the U.S. Copyright and Trademark Office to see if the name was officially registered?

If it was and it's a similar business venue, then tread lightly...especially if you start making lots of money. This could come back to haunt you.

  How about Hidee's Beautiful Photography? He can register the name but it doesn't give him exclusive rights to the words. ie Coca COLA, Pepsi COLA, RC COLA, etc.

  Thanks for the advice. I did search the USCT Office and it didn't come up. But to get it tradmarked will cost around $350.
What's more important to get first; State/city Business license?
web domain?
Tradmark?

(And it's not really "Beautiful Photography", I was just using that as an example).

  I would go ahead and apply for the city license. You may not need any kind of state license but I would check into it. Web domain won't take long to get at all. Don't worry about the trademark. Most small business don't have one.

  Justin, your good! Lol, I never would have though of that.

Thanks everybody for the responses! I've purchased a web domain... atleast I think I did. It still needs to be confirmed and I've got my state business license.
My city license will come next.

  Greetings Sharon.
Nope. The reason is because a local business license fees are used to support local municipal agencies including fire, police, pay for building code enforcement and help generate local tax base revenue for the community. The internet transcends all that. So, unless you're selling locally like out of a local store front, registered as a local business with a fictitious business name and/or have employees, UPS coming and going during the day, customers in and out, and have an overwhelming desire to pay a county assessor business equipment taxes on your computer and camera(s) then IMO no local ticket is required. ;>)
