  Reality is that the moment you make the image, and own the negative (or original digital file) you have a copyright on the image.

What you CAN do is register the image for $30.

The difference is this. If someone steals or uses your image without your permission, the most you can reclaim from that person is the moneys that "may" be lost by not paying you. In other words, they are only liable for the lot of potential income.

However, if your image is registered, you will not only have an easier time prosecuting the offender, but there is a potential $150k fee that can be tacked onto the penalties.

Even then, nothing is absolute.

So the reality is, if you are going to register an image, be sure it is an image that you think someone with money may possibly pilfer. Because some teenager taking images off your website will cost you more in court fees than it will in any monetary resitution you will recieve.

  Thanks for the information. The reason I am asking is my employer (in Real Estate) saw some of the local pictures that I had on my betterphoto site and wants to use a few of them and I wanted to make sure I had my rights ready before I went over the information with them.
