Copyright Question


I have a media pass to photograph a profesional indoor football game as a freelance photographer. I'm not affliated with any particular newspaper and have shot photos of the game, however I was contacted by the team regarding photos for their website. Who has the rights to the photographs? Does the league have the copyrights to photos or do I? I'm willing to provide them photos for the website but I was just wondering about who has the rights to the photos.

On the back of my media pass, it said ."The league has exclusive rights to all rights in, to and arising under the league football games, including but not limited to those related to photography...etc

Any input would be appreciated.

  They have the rights. Use for your portfolio, send some to Getty or IconSports for stock use if you can. Ask for credit whenever the league uses them.
But the league can use them in any way they want without any further compensation, or input from you.
If they're paying you once for the game, that's all you'll get.
Shoot some good ones, cash the check, ask to do another game.

The league didn't hire me to take these photos but after the game they asked me for some photos to be placed on the website. They also offered me an opportunity to take photos for the team in the future to be sold on the teams website, of course then I will be paid a portion for the photos sold.

So do they still have the copyrights, even if they didn't pay me to take the photos?

  Similar to when somebody shoots for a schools athletic dept. and somebody I know. Shoot the games, portraits for website and programs. They use any they want where ever they want, he gets to sell prints for anybody who wants them. Plus whatever they're paying him overall.
When that's on a pass that's given to you, it's like saying you're in agreement that we'll let you in on the condition of keeping rights.
It's good that you're getting portions of any prints sold, but they are looking to use the photos freely.
