Stock Separation Agreement
Dear Pro Photographer,My stock agency's separation terms are that: upon separation, they will continue to represent all of my images which they promoted on the web or in print for a period of five years after separation, in accordance with the terms outlined in the agreement. I'm not happy with this arrangement. I understand they may be entitled to profit from their promotion, but five years is too long, especially because they expect to keep an exclusive hold on these images for five years beyond separation. In other words, the effective separation on those images does not occur until five years beyond the separation date! I would more comfortable with co-exclusivity for the period beyond separation. Please let me hear what you know about this. Are there standards among stock houses? Is this sep. agreement typical, or exploitative? I will need to make a decision soon and try to negotiate a change with them as soon as possible. Your experience/insights will be much appreciated. Thanks, Barbara
