Photography Question

Mason Gray

Selected for Publication

I recently recieved notification of one of my photographs being selected for publication. My question is whether or not this is a scam. To be entered into the next level of competition, you must buy the book. This is what I was sent:

Circle of Photographers;
Dear Mason Gray,
We have chosen to publish your photograph in the 2005 edition of Photography vibes. Your photograph was part of a high number of entries. Our editors recognize its technical qualities. It is with great pleasure that we would like to inform you that your photograph:
Natural Beauty
has been selected to get published.

Though we do not offer royalties, your copy rights are fully respected.
You are also considered as part of finalists for our grand prize of $5000.

Please note that only members who order the 2005 manuscript qualify for the $5000 grand prize (this is required to fund the prize, to craft and print the manuscripts and to support our team - thank you for your understanding) and receive an invitation for the global photography conference.

Once you order, we will contact you soon with more details on that global conference (with photography experts and all 2005 contest winners working on technical/improvisation workshops).

Our editors select photographs on the basis of technical quality, composition, flow, texture and light. With respect to your photograph "Natural Beauty", our team of editors has particularly appreciated the assymetric composition and light mix used throughout.

All Circle of Photographers members can now view your photograph in our new manuscript and we will also present it to other publishers and photography organizations. We will ask for your authorization in the event your photograph is also selected by another publisher.

Our own manuscript is made of high quality, bounded paper. The manuscript contains professional illustrations. It makes a terrific coffee table book and a great gift to friends and family!
Should you want to receive a copy (copies) before reserves run out, please click on the "buy now" image button below.

Note: If you are Hotmail users, or you can not make payment to us by using the "BUY NOW" button at the left, please copy the following url and paste it in the address bar of your browser:
http://www.circleofphotographers.com/payment/payPhotoContest.php?ContestPhotoID=5082

For help, support, and enquiry, please feel free to contact us at help@circleofphotographers.com

Note: If you don't want to receive any further news from us, please click here to opt out. Or just send an email to cancel@circleofphotographers.com.

The manuscript "Photo Vibes" is priced at $59 to provide for the high costs of editing, printing and for the high quality book.

Please note that due to high demand and limited supplies, manuscripts are available on a first come, first served basis.

The Circle of Photographers team.

  It's more a "scheme",..than a "scam".
A scam suggest something illegal.
What they're doing IS legit..(if you read the fine print carefully).
Organizations like this one prey upon your vanity, as a marketing scheme to sell their publications.

When someone offers to PAY YOU for publishing your photographs, then you will know that your work is worthy of professional praise.
Until that happens, you would be wise to ignore any publishing offers that require a fee of any kind. They only want your money,...not your talent.

I fell victim and paid out $102.02 AUD.
They sent an e-mail to inform me exactly as you have copied and pasted above and all I could do is cry when I read it. I have been scammed by Circle of Photographers.. I won't say how embarrassed I now feel at being so gulible but learn this lesson from me,
I was so excited to think that a picture I have entered was good enough to go in a manuscript! Wow!

I didn't worry about whether winning $5000 as I assumed there'd be thousands with a better chance than me, but as my dog Sammy Sam is now 14 years *human, I thought that would be a wonderful way to treasure his beauty when that unfortunate time arises.

For your viewing I've added the photo for you to see, Sammy is the gorgeous Chihuahua X Foxie and he looks like he is laughing or telling a story only a dog could understand to our baby pug Tzu.

My heart feels torn as I had never before used my credit card online and
although I only wanted my credit limit to be $200 on the card I spent half of it on this organisation, all I pray is that they are blessed with the greatest misfortune if they do this to others.

As you can tell, I am furious, more so with myself more than anything for believing or for search of a better word, trusting, them!

After writing several times since sending payment I finally received two duplicate e-mails stating the following on 21.02.05:
___________________________
Dear Sir,

Thank you for your email.

The books are shipped in March. We incurred some delays because of our
contractor.

We apologize for this inconvenience.

We are crafting a quality book and would like to thank you for your patience

Sincerely yours,

The circle of photographers team

------------------------

is it not insult enough that I signed my e-mails with Karen, only to be referred to as sir, it is now 23.03.05 and still haven't any so called manuscript, my numerous e-mails to their address at help@circleofphotographers.com
have constantly been returned stating:

Hi. This is the qmail-send program at globat.com.
I'm afraid I wasn't able to deliver your message to the following addresses.
This is a permanent error; I've given up. Sorry it didn't work out.

I'm sorry to hear what you had to go through with these people. It's too bad there is no way to report them or have their website terminated. Thank you for the information though. All this is just another reason why I like THIS website so much. Thanks again . . .

Thanks but surely not as sorry as I am, I will know better in future and will do a lot of investigative work into any organisation name before I consider handing any money whatsoever over.
I have taken it upon myself to notify
Rip Off Report.
Perhaps anyone else who has had the same should consider posting a warning to all their also.

I sure hope this has prevented others making the same grave mistake I did.

I received the same (almost word for word) e-mail after submitting a photo to the Circle of Photographers about a week or so ago. I did not send any money - thank goodness! I did respond to the e-mail that I received with a lot of questions and have not received any answers back yet, and I don't expect to. Too bad this is not on the up and up

To read the latest about them and how to prove they are confidence tricksters' look at this page to see the picture I submitted.

honestly, they are pure evil!

I have written to The Maryland Attorney General's Office via e-mail I suggest anyone else taken in by them should do likewise: OAG@oag.state.md.us

I agree, they should be stopped!

I've never heard of this organization. I find it frustrating in that photographers are being taken advantage of in this manner. I guess they (COP) realize that any serious photgrapher desires the opportunity to be published. Simply take this as a lesson, and definately do not allow it to harbor future submissions to legit organizations. I'm certainly grateful for Better Photo, and all members who support one another in our craft.

There used to be a similar site called picture.com, aka poetry.com, and various other thingys. I'd say they changed their name because everyone got wind of what they were doing.

I too did the same thing. I was so thrilled to find that my photo was to be published, and luckily my parents wanted to check it out a little further. I am going to fight this, with my parents behind me, as much as I can. I have been in contact with all of the local investigative teams such as news stations, etc. I need as much documentation as possible and would love to hear from all of you. PLEASE email me with all of your emails, and let me know if I can print out this forum. Thanks, -Jeff

Dear Dean,

We would like to inform you that your manuscript has already been produced
and is in fact being prepared for shipment on August 25th, 100% garanteed.

We definily understand (and sympathize) that you eagerly aniticipate your
work but would like to bring to your attention that the order cycle has
been long because of:

1) The time it takes to select entries and wait until the end of the
contest (4 months)
2) The design of the book (1 month)
3) Production (11 weeks)

You will like your book as we have hired a professional illustrator for
some great art work and have expanded our photo techniques section. In
all: over 320 pages of great work, with your photo published.

Best regards,

the COP team

Hey all - I recently contacted the Ministry of Justice in Canada. My E-mail is as follows:

I am a US citizen who is also a avid photgrapher. Many like me around the world have recently been the victim of a scam. The "organization" is known as the Circle of Photographers and is based in Canada. The following site (type in as indicated below) tells a few of our stories. Feel free to contact me via E-mail or by telephone at (312) 627-4205.

  Here's the latest,
To no-ones surprise it is the 18th August, 2005 here in Australia.
7 months have passed and still I have no so-called manuscript
Imagine how much $102.02 would have increased for me in interest if I hadn't sent payment?
These low lives called 'Circle of Photographers' have made plenty interest out of unsuspecting victims, its a crime!
They know PayPal have a 45 day barrier in which to lodge a complaint but I think its high time PayPal blacklisted them from any lodge of payment.
Anyone sucked in by the circle of photography or beit poets should all write to PayPal and demand action be taken against these scammers. Afterall, they are forwarding our funds to them so chances are they know where they hold their accounts! Take charge now and DEMAND that PayPal get heavy for the sake of their customers.

  Hi all,

Thanks so much for the exchange on these "rats". Needless to say, I received an email from the so-called COP just 2 days ago after submitting a photo last Fri. I'm new at this and was jumping up and down with excitement until common sense got the better of me! Thinking it was too good to be true (within 24 hours working day response time), and the fact that there was no evidence of past year manuscripts on the website nor any information about who they are, I smelled a rat(s).

So Karen and Mason, I most appreciate to learn from your experience. And Dean and Jeffrey, feel free to add me to build up your case against them.

Eileen

  Ok guys,

Below is an exact copy of an e-mail I received from PayPal, I encourage everyone who, like me, was ripped off by Circle of Photographers or even Circle of Poets, to do the same..

I complained to PayPal that they were doing a dis-service to their trusting customers who use their service by ignoring genuine complaints about organisations such as those mentioned, and given PayPal would know where and what account the money is being transferred to should have the ability to Blacklist them and alert others who are preyed apon (the innocent victims taken in by the scam) by setting up a pop up notice that 'send your money at your own risk, this company or group have had complaints made about them to see the complaints click this link..'

PayPal sent me a link to a Feedback Survey where I complained even more stating that they ought to get their act together and have someone who knows their head from their behind to investigate and here below is their reply....

______________________

Dear Karen Sommers,

When you filed the complaint described below, we deferred investigation of
the complaint because some of PayPal's complaint guidelines were not met.
At this time, we have decided to open an investigation into this deferred
complaint. We are in the process of contacting the seller to inform them of

________________________

Hope this makes others sit up and do likewise, the more people who complain to PayPal they then have no choice but to listen..

I simply outlined to PayPal that people trust them, and when they are forwarding monies to these people they are inadvertidly conspiring with them to steal, thus leaving little to thier reputation to be desired. I noted to them also that these Scam organisations are aware that PayPal have a 30 day setup in order for one to file a complaint, and therefore take advantage of that. Leaving the victim little hope of having any action taken against these groups.. I said it's high time PayPal got up off thier butts and did something or I will go higher because afterall, the reputation is fragile if there is but one complaint.. isn't it?

Well, looks like a may have stirred a hornets nest.. maybe everyone else who have sent them money via PayPal can do likewise, why think of yourself as a mere drop in the ocean..

Kaz

Reason for Dispute:
Non-receipt
Buyer's Comments:
I entered a online competition with 'Circle of Photographers' they e-mailed me to say I won, and my entered photo would appear in a manuscript called 'Photo Vibes 2005'. I agreed and sent payment via PayPal, believing that PayPal wouldn't allow sights that are unorthodox to use their system in order to scam people out of hundreds of thier money they have on a credit card. I am extremely dissapointed to say the least. Your site offers one only 45 days in which to forward thier complaint, however, these Confidence Tricksters know this and deliberately make people believe that their Publisher is to blame and state that they are sorry for the hold up.. so of course the stupid innocent victim believes this to be the case and gives them the benefit of the doubt. But, once 45 days is up to no ones surprise they simply wipe their victims like toilet paper to their butt. I know others have paid via your PayPal trusted service, and have been advised that you can't do anything, well how many people have to complain about them before you will sit up and listen? You have the ability to Blacklist them I'm sure... if they are using us, they are also using PayPal giving you a bad reputation for not seeming to care for your customers security. I beg of you to make a link on your site for blacklisted companies or those that have had reports of not forwarding goods, your loyal customers' should have the knowledge of being advised that these people or sites have had reports made on them, at least do your user's the honor of being forewarned about who they are dealing with, by informing them, give them the choice to refuse payment to these scammers! Look at these sites of what others have to say, please take the time to read how heartbreaking this can be.. we are real people, not rich but have been conned and when a trusted site (or supposed trusted site) like PayPal forwards our monies then that is disturbing. -------------- http://www.betterphoto.com/forms/qnaDetail.a

Re: the request that I remove the complaint, I have absolutely no intention of doing so, maybe they'll just hope that I'll shut up and just go away.. after all, considering that after realizing I had been conned, I did a search on their so-called previous Manuscripts and hadn't found a single one!

If I end up, which I suspect I will, out of my $102.02 AUD, at least I will go down fighting even if it means just in saving someone else the heartache these mongrels have caused me and others like me.

I spoke on the phone today with PayPal and told them of The Circle of Photographers threat that unless I remove the complaint my shipping will not occurr..(or words to that effect).

I informed them that I will not under any circumstance remove my complaint. The man at PayPal customer service said "nor, would I because once you do the matter is considered dealt with and then to re-enstate the complaint will be likely to fall on deaf ears". which I agreed would be a stupid move.

He gave me a e-mail address for me to send a copy of the above e-mail from The Circle of Photographers (which I did) he said that
'in the subject line I should place my buyer dispute ID the number beginning with PP.......'

and e-mail to:
complaint-respond@paypal.com

I am providing this also for others who have been conned out of their money by the Circle of Poets or Circle of Photographers organisation, so they too can voice directly, the more people who have complain'd about them and or had been afraid to because the 45 day had lapsed now have a way of making a demand that PayPal remove these scum from their distribution..

I would also request others, likewise, demand PayPal place a Blacklist link on their site so others know who have already had complaints made about them. And therefore the consumer has a better chance of making a wise decision.

I do hope this serves others as a calling card to be very wary of the Circle of groups.. or any similiar.

I am happy to see that some action has been taken against the C.O.P. group. To my knowledge, Thomas is the only one of many MANY dozens that I have heard from by this site as well as through email that has EVER gotten a book. I leave it to your own discretion as to whether to apply for anything through this "organization". Be advised that a delay and subsequent hassles of this nature are not customary OR the norm for reputable businesses and organizations. Again, thank you to all of you for your input, opinions, and actions.

  Ok..

Here is the latest response..
-----------------------------
Dear Karen Sommers,

We have concluded our investigation of your Buyer Complaint. The details of
this claim are listed below.

We have decided in your favour, and as a result, have attempted to recover
funds from the seller.
The maximum amount we were able to recover was $77.00 USD. This amount has
been credited to your PayPal account. Please allow up to five working days
for this adjustment to be reflected in your PayPal account.

If you are due any additional amount from the seller, we will make our best
effort to recover the balance from the seller.

If the seller's account has insufficient funds to complete the refund owed
to you, please be assured that we will take appropriate action against the
seller's account, which may include limitation of the seller's account
privileges.

-----------------------------
See, it pays to speak up and yell your head off!

On the other side of the coin the so-called photo Manuscript is also supposed to be FINALLY on its way out from what I've been advised.
But I told them I didn't care for it any longer and preferred my refund in full.

Hold on to your money and save it for your own book. Betterphoto members have a better chance in creating their own books. All the images we all share are so great, we don't need scams to show how great we are. Hey! that's an Idea!! why not let Betterphoto promote our images on coffee table books. I see Betterphoto becoming even bigger and better.

Half your luck Dean but check this out...
I received an email stating that something was being sent via US Postal Services and gave a number to paste so I could use their tracking system.

I checked with my father who lives in Lincolnton NC whether he was sending out anything and he said no, so assuming the only other thing would be a manuscript I checked the number and it showed that it was accepted, not by me but someone else!

Here is the following sent via email below...
===========================================
This is a post-only message. Please do not respond.

Karen Sommers has requested that you receive the current Track & Confirm
information, as shown below.

Current Track & Confirm e-mail information provided by the U.S. Postal Service.

Service Type: Delivery Confirmation

Shipment Activity Location Date & Time

Enroute CINCINNATI OH 45235 09/09/05 1:48am

services and features, please visit the Frequently Asked Questions (FAQs)

===========================================

Now what I am angry about is that apparently this is now being marked as already accepted, not by me, but by someone in MANSFIELD OH 44901....
Could this be the same people?

Going by their previous email asking I withdraw my complaint or else it would have consequences on my delivery I feel annoyed that perhaps they are playing silly buggars with me now.

I couldn't care less about the manuscript anymore as I initially stated, and hope to have a full refund back in my credit card account very soon.

Additional note, I'm not surprised that my pic wasn't in there, absolutely disgusted that they'd even poorly print your picture.. Circle of Photographers/Poets ought to be BLACK LISTED on every site!!!

Do you feel that your money was money well spent?

Aurora, I think the suggestion for BetterPhoto to produce a coffee table book would be an excellent choice, as least we know they are legitimate, and I don't think people would mind contributing towards the production of such a book.

But geez am I annoyed that Circle of Photographers can be so brazen and dishonest in their dealings.

Karen,

Thank you for visiting our web site. I apologize that you have not received the manuscript with the number 0304 1070 0001 6088 0046.

The number you have provided is a Delivery Confirmation number, which is only used for domestic mail. This service is not available for International mail. I recommend contacting the sender to see what address they sent this manuscript to.

If you have any other questions, please let me know. Thank you for using the United States Postal Service.

But thanks to you and others like you, that have taken the time to post there stories, has save me and hopfully others from sending these jerks and money. I hope you get your funds back, money comes to hard to have rip-offs just to steal it from you. I just wanted to say thanks and good luck.

  Hi,

Is Circle of Photographers same company picture.com and International Library of Photographers? If so, this company indeed needs to be put out of business. I finally receive the book after I put in a complaint to the Attorney General and I promptly return the book for it was of poor quality and my photo was faded. The results are they finally refunded the 77.95 they scam from me. I recommend to put your complaint to Attorney General of Maryland. I hope all goes well.

I also received a letter that my picture was selected out of 8523 entries.
People should be wary when going to a website that shows a contest entry form on the home page. They claim there is a high demand for this book but they won't even sell it openly. I haven't even seen it on ebay or amazon. The only people who buy the book are those who enter the contest and some person sitting at a computer in a Montreal apartment sees the photo and likes it sends you a letter. I even mentioned that ripoffreport.com has many complaints about you but they/he won't bother to respond to them (at least not now) and I don't think they/he will.

Also no one seemed to mention the fact that there was an invitation to a global photography conference in the email. Is there a global photography conference?

I have put out a scam alert on my website (I'm not afraid to say it's a scam) which is tebgallery.com. Note: Because of lack of response I'm closing down my website at the end of the month (September 2005)

  And here is the latest..

PayPal have hunted down this company and I received around what I paid minus $2 well, I'm pleased I plugged on and kept writing to PayPal, so forget the 45 day cooling off period, if you pay and don't receive harp harp harp! In the end one way or another it pays off.

Interesting isn't it? Always hear people say, "you can't beat the system". Amazing what individuals can do when given the opportunity. I'm glad the word is getting out and even happier to hear that through people like Kaz, Thomas, Dean, and others, people are learning to be more cautious and investigate organizations. Take care of yourselves and thanks again for all of the stories, comments, and hard work.

I've got a better suggestion. For those of you that feel it necessary to waste money on these schemes and scams, just send me half the money. You'll get the satisfaction of spending the money, but with the added benefit of only spend half as much.

This is a return letter that was sent in reply to their latest "$49 book" letter:

It has been made abundantly clear on many prominent websites, blogs, and forums that your "organization" is by no means reliable, trustworthy, or qualified to decide what and/or who's photography is worthy of publish. It has ALSO been revealed that you have come in to dispute with Paypal over failure to provide the services offered as well as your group being reported to several bureaus and offices in both the United States as well as Canada. If you have any questions about whether I am interested in your "product", let me make it perfectly clear. DO NOT CONTACT ME AGAIN FOR ANY REASON!

I too recieved this email after sending a picture but would not send money because I figured if I already had the picture why would I pay to see it in a journal? The site even says that it is printed on paper but that the cover is laminated. Laminated? C'mon...at least give me fake leather or something...LOL. Thanks to everyone for posting your stories. If I ever make my way back to Montreal I will hunt these people down and punch one of them square in the nose...hehe...then take a picture and post it here...LMAO...

I, too received the same letter (exact same wording, too). I wanted to believe it, but was skeptical at the same time. So, I ordered, using PayPal (because they'll back you up). I obviously received nothing except empty promises. I reported them to PayPal, which got my refund for me and now has record of the fraud.
Whenever in doubt, use PayPal (if possible), as they can and will get your money back AND take note of the complaints (not sure how far they go with the complaints, but at least they get your money back!).

These people are crazy!!! I also received the same email. They said my photo was selected for "the assymetric composition and light mix used throughout". I replied to them I was flattered but my photo ACTUALLY exhibited more symmetrical or even radial composition and was no where near close to anything assymetrical. LOL...thought you'd all enjoy that one. Including a photo they "selected".What a bunch of idiots they are.
