Another Model Release Question


Here's an interesting situation- perhaps someone can give me some advice about it. If I am at a non-profit agency taking pictures in their building of their surroundings and their "business", do I need to get a model release for the people who are recognizable if they are going to make a brochure with the pictures?

  YES and NO! If you are shooting for the client/agency and are shooting official employees, neither you nor the agency is required to get a release. However, if you did get them that insulates you from any potential problems down the road like an angry employee who got fired or something. If the general public appears in the photos then you can have expensive problems should someone see the brochure and claim they did not give permission to be photographed or have their photo used. I have been a stock photographer for 30 years and own a stock photo agency, www.fogstock.com and every year we have people threstening to sue because they claim they appear in a photo without permission. So far I model release files have kept them away as we can prove it is not them.

  I say better safe than sorry... If they are recognizable you should get a release. Why take any chances of getting sued!
