Photography Question

Nicole Boenig-McGrade

Copyright as an employee

If an employer asks an employee to take some photos (both during employed hours and private unpaid hours) and the employee uses their own private equipment as the employer does not own adequate gear:

Q1: Who owns the copyright of the photos in the case of shoot done during employed working hours?

A2: Who owns the copyright of the photos in the case of shoot done outside working hours and with a very minimal fee?

Q3: Who owns the copyright if the photographer allows the employer to use his/her own stock photos?

These seem to be very simple questions, but can present complications.

Your comments would be most appreciated. Kind regards from West Australia, Nicole
