Image use for merchandise - Royalties?


Hi folks... does anyone out there currently have some of their images in use for merchandise/products/stationery, and you're operating with the vendor under a royalty agreement? (Such as, they pay you X% of the item cost, for each merchandise item they sell)?

  Hi Chris,

Yes I've done this. Aside from the more typical licensing through Getty, I licenced the likeness of my work to a local touristic shop owner (artison) selling on both T shirts and hats.

I was not particularly thrilled with the concept from the very beginning based on strong personal differences and his lack of (shocked)) marketing experience. We went round and around the carousel literally as he tried to squeeze my profit out of the spreadsheet. He has used places like Vista to make window posters in the past and assumed they would print and supply T shirts at no profit to themselves! I think he envisioned most visitors to his quiet little corner of the world to walk out with hats and Tee's at almost $30.00 ea.

Anyhow, I limited (capped) the total number of production run on this as a way for me to back out whenever I felt it was time to do so.

We reached agreement by splitting a pct. from each sale, pre-determined up front.

  Thanks, Thomas... I'm looking at a little different situation (at least in terms of experienced vendor---in that the folks that may end up using my imagery operate stores nationwide.)
However, that doesn't mean they will be looking out for me & my interests at all, in terms of squeezing every drop of profit they can get! ;) I'll send you an email shortly. Thanks
