Images for promotional use


I recently took photos at an all day competition. I was not paid to shoot, but had permission from the owner of the arena. I looked at it as good experience and I might sell a few photos.

The owner of the arena now wants me to email her the photo I took of the winner to put on her website and to use for "promotion". Also, she wants me to put her logo on the photo. (I did not design the logo)

This is foreign territory to me. I don't want to burn bridges with this person but I also don't want to get taken advantage of. I feel my work is worth something, but since I am just starting out, I feel I have little bargaining power. And how do I control what the photo is used for once I email it? I can't, can I?

It feels like everyone is saying "you should give this to me because it's good exposure for you". That may be true, but I just want credit where credit is due. Is that too much to ask?

Do I need to get something in writing as to specific uses for this photo?

  Hi Lora, great question! Just so happens I'm offering a course at Betterphoto.com--Photography for Writers and Bloggers--that details all you ask.

I had a similar thing happen to me. I had done a shoot for some builders for which I got a one-time fee. The builder used the photographs everywhere but I never got any more money. Se le vi--I made an agreement for one fee with the assumed use of publish anywhere and anytime. Not a good business decision, indeed.

Now I state up front what my fees are as well as what conditions the client may publish the photos--for example, one time only.

Tell the arena owner what you want in terms of compensation for letting her use the photos. At this point, though, all I would ask for is that she put your credit on or as a caption for the photos she uses. And...if you do any work such as put her logo on a photo, you should let her know how much you charge for that.

  Lora,
I personally can understand giving her rights to use the portrait in any and all advertising. I would not however put anyone else logo on my print at any time.
also, Do you have a signed release from the winner whos portrait you took?
If not you can not begin to publish or sell this image to anyone.
YOu should get in contact and get a release ( if you don't have one email me I will send you mine for copy)
and then think this though as once you put her logo on this image she has control of any sales, ect.
I sell Cd's of my work if a client would like to purchase one of thier session but I put my logo on every image.
I hope this helps, it's just my opinion,

GOOD JOB!!!
someone ones to steal from you right off the bat! Yeah!lol.

Oh and you always have the power, you own the image they want.
Please remember this.
and we all at times start as amatures in one field or the other in photography,
but we aren't stupid.
You'll be fine with or with out her promotion.

  Thanks for the quick responses. About the logo, it would be on the photo promoting the arena and the competition, but my name would still be at the bottom. If there was an understanding that it would REPLACE my name, I apologize.

Are you saying that even if my name is at the bottom, I still should not add any other logos??

  Yes, I was thinking that she wanted just her logo on your print.
Now this is truly where the desision lays with you and how much you think it will do for you in the venue that you want to work.
do you have a release though?
