Selling the Rights to a Photo
Please help me give an accurate/reasonable price quote ... many thanks. (If it doesn't load here, I'll post the image in my gallery - titled Intervention.)

Greetings, Jay. Usage rights versus all rights are two different things. Generally, when considering what to charge for usage, you need to consider (among other things) whether the photo has been published before (like First North American publishing rights); whether they'll print your photo credit; size of the poster; how much giving them unlimited discretion to modify the image is worth to you; and the value of the photo to the potential user and you. In this case, unless you have a model release from this fellow, your own use of the photo is significantly limited in terms of publishing; you also need to consider the press run - i.e., how many posters, what he intends to use them for (like enclosures in a marketing campaign or a magazine insert); whether he wants all the usage rights, including publicity releases (media kits), the illustrating of articles about him (like in Rolling Stone), etc.; and AND whether you continue to have the rights (after he signs a model release) to use the photo for your own purposes, like stock photography. Easy, no?? As to price: After you've considered these factors, among others you may come up with, how much is strictly up to you. You can look around the Advertising Photographers of America Web site for a cost survey done a few years ago among our members. That may help get you seated better in the ball park, so-to-speak. ;>)

Just a brief piece of advice, Jay, do not assign your copyright to anyone. Rather, you offer a licence to use your picture on agreed terms. I can't suggest an appropriate price since I'm in England and use my union's (NUJ) rate card to guide all my picture sales and licensing. However, Mark has provided a useful source for this in the States. Good luck!

Where was this shot? How did you get permission from the hall to put strobes in the ceiling? That was a great idea and I'm surprised they let you do photography, most places won't allow it. I guess I had to be there to understand how the title fits with the photograph.

Jay, I agree with Roz in that you sell usage rights (which I thought was what you were asking) rather than the entire copyright to someone, unless of course you have no further use for the image other than for personal use. The rate card Roz mentioned is similar to the survey APA did a while ago. However, APA and ASMP had been sued for price fixing in violation of antitrust laws here in the U.S., and so the survey became just that, a survey rather than recommended rates. :>) It still contains some very useful information.

Thanks, all. I've hit an obvious snag. The young man in the picture is yet to be identified and I have no release, but in due time i'll find him and hopefully get the OK. RE: At 'SOKOL Underground' in Omaha, NE. I called the venue in advance, I also talked (via email) to the artist, the rapper - Sage Francis (www.sagefrancis.net) and got the 'go ahead' to go ahead. I fired two strobes wirelessly with pocket wizzard remotes. I used to shoot alot of arena sports so I just adapted my setup to the concert hall. RE: Sage Francis is a VERY socially concious man. He's an ardant supporter of clean living - for physical and mental health. He's not a drinker, not a smoker, not on drugs. He's a 'real vegetarian.'
