Can you shoot others property from the road


 
 
Hi, I am new to the digital world, Sometimes when driving I see some wonderfull shots in peoples landscapes and would love to pull over an take a shot or two from the roadway..but then I become afraid as if I am doing something illegally,I am not wanting to sell these pictures but just use them in my photography class, for example someones barn or covered bridge but they are close to the persons home,I have thought about knocking on thier doors an asking but I dont want to take up the time or chances of being bitten by a dog..these places are in the country farm lands....what should I do? take the shots from the road anyways or just forget the shots altogether?

  As long as you don't plan on selling them, yes you can shoot to your hearts content. If you did want to sell them, or post them somewhere(BP for example) you would need a model release. In your classes, what would you be doing with them?

  Hi Penny,

I find that most people are flattered and think of it as a compliment if you want to photography their property. General rule of thumb is to get a property release if you plan to use it to sell or in print in a magazine, etc. This usually doesn't apply for anything news worthy that would appear in the paper.

If you are only using it for a class, I would suggest asking for permission to photograph, explain what you will use it for and offer to give them a print of what you are shooting. Most people are happy to have someone appreciate their efforts in landscaping or their property.

I have had a few properties where I was afraid to approach because of dogs or invading privacy. You can always send them a polite letter asking permission and include your phone number.
